4.2 Stablecoins and the GENIUS Act

  • Law: the GENIUS Act became Public Law 119-27 on 18 July 2025 (govinfo, Congress.gov) [V-s]. Its surveillance architecture is in the statute itself:
    • A permitted issuer "may issue payment stablecoins only if the issuer has the technological capability to comply, and will comply, with the terms of any lawful order."
    • A "lawful order" is one that "requires a person to seize, freeze, burn, or prevent the transfer of payment stablecoins."
    • Foreign issuers must have the same capability or face a trading ban.
    • The 2026 proposed rule from FinCEN and OFAC (the Treasury's anti-money-laundering and sanctions arms) would extend block, freeze and reject duties to secondary-market transactions (Sullivan & Cromwell) [V-s].
  • The anti-CBDC flip side:
    • The executive order of 23 Jan 2025 prohibits agencies from any action to "establish, issue, or promote CBDCs" and frames CBDCs as threats to "individual privacy" (whitehouse.gov) [V-s].
    • The House passed the Anti-CBDC Surveillance State Act (H.R. 1919) by 219–210 on 17 July 2025, the day before GENIUS was signed (House Clerk). Not enacted (Congress.gov) [V-s].
    • So the state disclaims a surveillance-capable public digital dollar while legally mandating freeze and burn capability in private ones.
  • Trump family conflict:
    • World Liberty Financial (WLF), linked to the Trump family, launched the USD1 stablecoin in March 2025.
    • MGX, the Abu Dhabi fund, used USD1 to pay for its $2B Binance stake.
    • Senators Warren and Merkley called this "an unprecedented conflict of interest." WLF replied that USD1 kept the deal "denominated in U.S. dollars" instead of dirhams (Senate Banking letter) [V-s].
    • Note: MGX is also a Stargate equity partner (§2.4), and the GREAT Trust plan names a highway after MBZ (§D3).
  • UH lead check: "the Bitcoin-dollar: stablecoins and BTC used to expand dollar dominance and absorb US debt; GENIUS is the culmination of the PayPal Mafia's efforts" → PARTLY SUPPORTED.
    • The dollar-dominance and Treasury-demand rationale is the administration's own (WLF says so explicitly; Bessent's statements weren't fetched [R]).
    • The freeze and seize architecture is in the statute.
    • "PayPal Mafia culmination" is interpretive. Sacks, the AI and crypto czar, is a PayPal alumnus, but the bill was bipartisan.
    • "Bitcoin as debt sink" is speculative [U].
